No mare can be bred without a signed, completed contract, a copy of the mare’s registration certificate, health certificate, and payment of the booking fee.

1. All information, documents, fees, and contracts listed in this contract are mandatory and must be provided before your mare will be bred or boarded.

2. The Mare Owner certifies that he is the legal owner of record or recorded lessee of this mare. A copy of the mare’s registration must be included with this contract.

3. Mare must have had health inspection, uterine culture, and updated vaccinations prior to breeding.

4. Stallion is standing at stud at The Bluebird Morgan Farm. Hand breeding is currently the only method used. Future use of artificial insemination (AI) and semen transport (ST) are being considered. All expenses associated with AI and ST would be over and above the Stud Fee and would be paid by the The Mare Owner.

5. All board, veterinary, medical or other related expenses on the above named mare will be paid by the The Mare Owner.

6. The Bluebird Morgan Farm reserves the right to withhold signature of AMHA foal registration application until all fees due The Bluebird Morgan Farm have been paid and until applications are completed in full by The Mare Owner.

7. Return of Service: In the event that the mare does not conceive, or if she should abort after conceiving, or otherwise fail to produce a live foal, The Mare Owner shall have the right of return service without additional stud fee. If the mare is covered by, or exposed to any other stallion after she has been bred, the The Mare Owner shall have no right of return service.

8. LIVE FOAL GUARANTEE. For the purposes of this contract, a live foal is defined as one who stands and nurses. Live foal guarantee: If the foal is born dead or does not stand and nurse, the mare which is the subject of this contract may be re-serviced to the stallion of this contract within the calendar year’s breeding season of the year the foal is born dead, provided, however that The Mare Owner complies with the following conditions in addition to those set forth by this contract, Should the foal be born dead or die before standing and nursing the The Mare Owner must notify the stallion owner by certified mail. The notification must contain certification by a licensed veterinarian attending the mare that the foal was still born or didn’t stand to nurse, together with the reasons therefore; as well as certification by The Mare Owner and The Mare Owner’s veterinarian that the death of foal did not result from any act or omission of the The Mare Owner or any other party and the The Mare Owner had exercised all due care and afforded subject mare all reasonable protection. The Bluebird Morgan Farm will not be obligated to honor the live foal guarantee if the foal dies due to negligence of The Mare Owner or it’s agents or employees Should the stallion die or become unable to service mares, The Mare Owner may breed to another Bluebird Farm-owned stallion, if available. If no other stallion is available, the Live Foal Guarantee is not in effect. In the event that the mare dies or otherwise becomes unfit, the The Mare Owner may assign the contract to a substitute mare with written notice to The Bluebird Morgan Farm.

9. If the stallion dies or becomes unfit for service before the mare is serviced the booking fee shall be refunded. Should the stallion die or become unfit after the mare is serviced, but before she is in foal, the booking fee will not be refunded. Should the mare die or become unfit for service before being serviced, any fees paid, less booking fee, will be refunded OR the fees can be assigned to another mare upon written notification of the stallion owner. Should the mare die or become unfit for service after being serviced, the booking fee shall not be refunded, but all fees can be assigned to another mare upon written notification of the stallion owner.

10. Warranties: Stallion owner warrant that the Stallion’s blood type has been recorded by the American Morgan Horse Association and they agree to execute all documents necessary for the registration of any foal resulting from this breeding. Stallion owners further warrant that the stallion is healthy and free of communicable disease. No other warranties, expressed or implied, not otherwise included in this contract, shall be enforced.

11. The Mare Owner understands that the stallion may on occasion compete away from home during the breeding season. The Bluebird Morgan Farm shall give notice to The Mare Owner, by phone or mail, of any conflict between the stallion’s competitions and The Mare Owner’s breeding dates.

12. The Mare Owner hereby agrees, jointly and severally, to indemnify The Bluebird Morgan Farm and hold The Bluebird Morgan Farm and it’s agents harmless against and from all losses, damages, claims, actions, causes of actions, suits, judgements, and proceedings of every nature and description arising out of or any way connected with the mare and/or foal, or the breeding, care, custody or control of the mare and/or foal, including, but not limited to, any or all costs, expenses and legal fees incurred by The Bluebird Morgan Farm in connection therewith. During the time the mare is in the custody or under the control of The Bluebird Morgan Farm or it’s agents shall not be liable for any illness, stray, theft, death or injury which may be suffered by the mare and/or foal at side, or for any other claim or cause of action whatsoever arising out of or in any way connected with The Bluebird Morgan Farm or it’s agent’s care, custody, control, breeding, boarding, or transporting of the mare and/or foal. This shall include, but not be limited to, claims of causes of action for personal injury, commercial loss or damage, consequential damages, or any other expense or cost which The Mare Owner may receive or incur while mare or foal are on The Bluebird Morgan Farm or it’s agents premises.

13. The Mare Owner hereby authorizes The Bluebird Morgan Farm or it’s agents at The Mare Owner’s expense, to secure veterinary, farrier or transport services as needed while the mare is under the custody of The Bluebird Morgan Farm or it’s agents.
